- Secured the entry of an order granting summary judgment in a medical negligence case in the face of plaintiff’s motion to voluntarily dismiss, which, on appeal resulted in the pronouncement by the Illinois Supreme Court in a case of first impression that the trial court may hear and decide a motion which has been filed prior to a motion for voluntary dismissal when that motion, if favorably ruled on by the court, could result in a final disposition of the case.
- Defended helicopter component manufacturer against several lawsuits stemming from crash of helicopter in Gulf of Mexico, and securing a dismissal of all claims against manufacturer on the eve of trial amounting to less than 1% of total damages awarded by the jury against the remaining defendants.
- Secured dismissal with prejudice of a prisoner’s claim for civil rights violations which was upheld by the Federal Appellate Court.
- Defended a manufacturer of hydraulic equipment against $30 million breach of warranty, business interruption, and economic loss claim brought by manufacturer of recreational vehicles, and securing favorable settlement prior to trial.
- Secured dismissal with prejudice of libel and slander claim against a condominium association.
- Managed product liability claims and defending numerous lawsuits across the country against foreign manufacturer of ceramic hip implants for the alleged failure of the implant, which resulted in fewer lawsuits and minimized significant potential liability to manufacturer.
- Secured dismissal of strict liability, emotional distress and punitive damage claims in action brought against commercial sellers and distributors of blood, alleging that hemophiliac who purchased and injected into his body antihemophilic factor contracted Acquired Immune Deficiency Syndrome (AIDS) as result of defendants' failure to perform screening and heat-treating tests and failure to warn hemophiliac of product's risks, and in conjunction therewith, securing Federal Rule 11 sanctions for plaintiff’s attempt to recover punitive damages under the Wrongful Death Act.
- Secured summary judgment in a medical negligence claim on the basis of admissions obtained from the plaintiff’s expert witness during the course of his deposition.
- Secured summary judgment in favor of subcontractor on construction project from claims brought by construction worker for personal injuries.
